Terms of Use, Medical Education Disclaimer, Refund Policy, and Privacy Policy

Effective date: September 5, 2025

These Policies govern your access to EMedLearn websites, online courses, educational materials, and related services. By accessing the Services, creating an account, or purchasing a course, you agree to these Policies.

If you do not agree, do not purchase or use the Services.

1. Terms of Use and Sale

About EMedLearn

The Services are provided by:

EMedLearn LLC
25 Stage Road
Old Saybrook, Connecticut 06475
United States
operations@emedlearn.com

“EMedLearn,” “we,” “us,” and “our” refer to EMedLearn LLC. “You” and “user” refer to the person accessing or purchasing the Services.

Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to purchase or use the Services.

The Services are intended primarily for healthcare professionals, healthcare students working under appropriate supervision, and other qualified individuals seeking professional education.

The Services are currently offered for purchase in the United States and Canada. EMedLearn may decline, cancel, and refund orders originating from unsupported jurisdictions.

Individual Use

A course purchase provides a limited, revocable, nonexclusive, and nontransferable license for one purchaser to access the course for personal educational use.

A course purchase does not transfer ownership of the course or any intellectual-property rights.

Unless EMedLearn provides prior written permission, you may not:

  • Share an account or login credentials;

  • Permit another person to use your enrollment;

  • Present an individual enrollment to a group or institution;

  • Record or screen-capture restricted course content;

  • Copy, distribute, publish, sell, or sublicense course materials;

  • Remove copyright, attribution, trademark, or branding notices;

  • Use course content to create or market a competing product;

  • Circumvent access controls or security measures; or

  • Use substantial course content to train an artificial-intelligence system or create a commercial dataset.

You may retain reasonable personal notes and use resources that EMedLearn expressly designates as downloadable.

Downloadable resources may not be redistributed or used commercially unless EMedLearn expressly permits such use.

Account Security

You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.

Notify EMedLearn promptly at operations@emedlearn.com if you believe your account has been accessed without authorization.

Acceptable Conduct

You may not use the Services to engage in unlawful, fraudulent, threatening, harassing, discriminatory, defamatory, deceptive, infringing, or privacy-violating conduct.

You may not interfere with the operation or security of the Services or attempt to obtain unauthorized access to another account, course, system, or restricted material.

Comments and Submissions

You must not post content that is unlawful, threatening, harassing, discriminatory, defamatory, deceptive, promotional, infringing, clinically dangerous, or violative of another person’s rights.

You retain ownership of content you lawfully submit. By submitting content through the Services, you grant EMedLearn a limited, nonexclusive license to store, display, reproduce, and moderate that content as reasonably necessary to operate and protect the Services.

EMedLearn may remove content or restrict commenting privileges when reasonably necessary but is not obligated to monitor every submission.

Intellectual Property

The Services and their original content—including videos, text, graphics, diagrams, ultrasound images, branding, assessments, handouts, downloads, and course organization—are owned by or licensed to EMedLearn LLC and are protected by applicable intellectual-property laws.

“EMedLearn” and associated logos and branding may not be used without prior written permission.

Third-Party Services

The Services may rely upon or link to third-party platforms, payment processors, publications, organizations, manufacturers, and websites.

EMedLearn does not control and is not responsible for the availability, security, accuracy, content, or privacy practices of independent third parties. Your use of a third-party service may be governed by that provider’s terms and policies.

Mention of a product, manufacturer, journal, professional association, institution, or credentialing organization does not imply sponsorship, affiliation, or endorsement unless EMedLearn expressly states otherwise.

2. Medical Education Disclaimer

Educational Purpose

EMedLearn courses, videos, images, illustrations, assessments, downloads, discussions, and related materials are provided solely for educational and informational purposes.

The Services do not constitute medical advice, diagnosis, treatment, prescribing guidance, medical direction, or individualized clinical consultation.

Using the Services does not establish a clinician–patient, instructor–patient, supervisory, employment, or other professional relationship between you and EMedLearn or any EMedLearn owner, instructor, contributor, employee, or contractor.

The Services must not be used to obtain emergency assistance or real-time guidance for patient care.

Independent Clinical Responsibility

You remain solely responsible for your clinical decisions, actions, omissions, and patient care.

Before applying course information, you must independently determine whether it is appropriate based on:

  • The individual patient and complete clinical circumstances;

  • Your education, training, experience, and demonstrated competence;

  • Your professional license and scope of practice;

  • Applicable laws, regulations, and professional standards;

  • Employer and institutional policies;

  • Credentialing and privileging requirements;

  • Current clinical guidelines and standards of care;

  • Manufacturer instructions and medication labeling; and

  • The availability of appropriate supervision or consultation.

Course information should not be used as the sole basis for a diagnosis, treatment decision, procedure, medication decision, or determination that additional evaluation is unnecessary.

Training and Competency

Online education is not a replacement for supervised hands-on training, clinical experience, competency assessment, credentialing, certification, or institutional privileging.

Accessing or completing an EMedLearn course does not authorize you to perform a medical procedure.

You are responsible for obtaining the education, supervised experience, evaluation, and authorization required before performing any procedure independently.

Certificates

An EMedLearn certificate documents completion of the identified educational activity only.

Unless expressly stated otherwise in writing, a certificate does not represent:

  • Professional certification;

  • Board certification;

  • Clinical competency;

  • Credentialing or institutional privileging;

  • Licensure or an expanded scope of practice;

  • Eligibility for employment; or

  • Approved continuing-education credit.

You may not alter a certificate, permit another person to use it, or misrepresent its meaning.

Medical Information Changes

Medical evidence, guidelines, equipment, medications, manufacturer instructions, regulations, and standards of care change over time.

EMedLearn may update, correct, replace, reorganize, or remove content. EMedLearn does not guarantee that every item will be complete, error-free, or current at all times.

You are responsible for independently verifying clinically significant information through current authoritative sources, clinical guidelines, medication labeling, equipment instructions, and institutional policies.

Suspected errors may be reported to operations@emedlearn.com.

Medications and Medical Devices

References to medications, doses, medical devices, ultrasound systems, manufacturers, procedures, or commercial products are educational examples.

Such references do not constitute prescribing guidance, medical advice, product endorsement, or a representation that a particular product or technique is appropriate for a particular patient.

Before using a medication or device, consult current prescribing information, contraindications, warnings, manufacturer instructions, safety notices, applicable regulations, and institutional requirements.

Illustrations and Clinical Examples

Ultrasound images, videos, diagrams, measurements, demonstrations, and clinical scenarios may be simplified, annotated, edited, or selected to illustrate particular teaching points.

They may not show every possible anatomic variation, artifact, technical limitation, disease process, complication, or patient presentation.

Patient Privacy

Do not submit, upload, disclose, or post protected health information, identifiable patient information, confidential institutional information, or information you are not authorized to disclose.

This prohibition includes patient names, dates of birth, medical-record numbers, contact information, recognizable photographs, identifiable imaging, and combinations of facts that could reasonably identify a patient.

This rule applies to comments, forms, emails, assignments, messages, support requests, and all other interactions with EMedLearn.

EMedLearn may remove such information and suspend or terminate the responsible account. You remain responsible for satisfying your professional privacy and confidentiality obligations.

3. Course Access and Refunds

Course Access Period

Unless an offer expressly states otherwise, purchasing an individual EMedLearn course provides 365 days of access beginning on the purchase date.

The purchase is a one-time payment and does not automatically renew unless the checkout expressly identifies it as a recurring subscription and the purchaser affirmatively agrees to recurring billing.

Course access expires automatically at the end of the stated access period.

During an active access period, EMedLearn may update, correct, replace, reorganize, or remove material to reflect developments in evidence, clinical guidance, technology, safety information, or course design.

Access includes updates made to the purchased course during the active access period. It does not include separately released courses, new products, live instruction, or future editions sold as distinct offerings unless expressly stated.

A certificate earned during the access period remains a record of course completion after access expires. A certificate does not establish that the learner’s knowledge remains current or that the learner maintains clinical competency.

EMedLearn may offer an optional extension, renewal, or updated edition at the price and terms then available but is not obligated to do so.

Technical Availability

EMedLearn does not guarantee uninterrupted or continuously available access.

Access may be affected by maintenance, updates, internet failures, third-party platforms, security events, or circumstances outside EMedLearn’s reasonable control.

EMedLearn will use reasonable efforts to address material access problems reported to operations@emedlearn.com. When appropriate, EMedLearn may provide a reasonable extension for a substantial interruption within its reasonable control.

Seven-Day Refund Policy

A purchaser may request a refund within seven calendar days following the original purchase date by emailing operations@emedlearn.com.

Approved refunds will ordinarily be returned to the original payment method. Processing time may depend upon the payment provider and purchaser’s financial institution.

Refunds requested after seven calendar days are not guaranteed unless required by applicable law.

Refunding a purchase terminates access to the applicable course and related materials.

Duplicate or apparently unauthorized charges should be reported promptly so they can be investigated.

Nothing in this Refund Policy limits a non-waivable consumer right.

Suspension and Termination

EMedLearn may suspend or terminate access when it reasonably believes that a user has shared an account, distributed course materials, misused a certificate, submitted patient information, engaged in unlawful activity, compromised security, harassed another person, or materially violated these Policies.

When appropriate, EMedLearn may provide notice and an opportunity to correct a violation. Immediate action may be taken when necessary to protect patients, users, privacy, security, intellectual property, or legal rights.

Refund eligibility following termination will be determined under the Refund Policy and applicable law.

4. Warranties and Liability

Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.

EMedLearn does not make an express or implied warranty concerning the accuracy, completeness, availability, fitness for a particular purpose, merchantability, noninfringement, clinical applicability, or results of using the Services.

EMedLearn does not guarantee any particular educational, professional, examination, procedural, clinical, or patient outcome.

Nothing in these Policies excludes a warranty or consumer protection that cannot lawfully be excluded.

Limitation of Liability

To the fullest extent permitted by applicable law, EMedLearn LLC and its owners, instructors, contributors, employees, contractors, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or relating to the Services.

Users retain sole responsibility for their clinical decisions, professional conduct, application of educational information, and patient care.

EMedLearn is not responsible for an injury, loss, adverse clinical outcome, professional claim, or malpractice claim resulting from a user’s independent interpretation, application, misuse, or reliance upon educational content.

To the fullest extent permitted by applicable law, EMedLearn’s aggregate liability arising from a purchased course will not exceed the amount the claimant paid EMedLearn for that course during the twelve months preceding the event giving rise to the claim.

Nothing in these Policies excludes or limits liability that cannot lawfully be excluded or limited.

Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless EMedLearn LLC and its owners, instructors, employees, contractors, and affiliates from third-party claims, damages, and reasonable expenses arising from your unlawful use of the Services, unauthorized distribution of course materials, infringement of another person’s rights, disclosure of confidential patient information, or material violation of these Policies.

This provision does not require you to indemnify EMedLearn for liability that cannot lawfully be transferred to you.

EMedLearn may share information with service providers that support website hosting, course delivery, payment processing, analytics, communications, security, data storage, accounting, and professional services.

These providers may use information only as permitted by their agreements and applicable law.

Cookies and Analytics

EMedLearn websites and service providers may use cookies and similar technologies to operate the website, remember preferences, maintain security, understand website usage, and improve performance.

Browser settings may allow you to block or delete certain cookies. Disabling necessary cookies may prevent some website or course functions from operating correctly.

Marketing Communications

Purchasing a course does not automatically require you to consent to promotional email.

If you elect to receive marketing communications, you may unsubscribe using the link in an email or by contacting operations@emedlearn.com.

You may continue to receive transactional messages concerning purchases, account access, security, policy changes, and customer support.

Data Retention

EMedLearn retains information for as long as reasonably necessary to provide the Services, maintain business and educational records, satisfy legal and accounting obligations, resolve disputes, prevent fraud, and enforce agreements.

Retention periods may vary depending on the type of information and reason it was collected.

If you believe a child has provided personal information, contact operations@emedlearn.com.

By purchasing a course or creating an account, you consent to receive transactional electronic communications relating to purchases, receipts, course access, account administration, security, support, and material policy changes.

Promotional communications are subject to separate consent and applicable law. Declining marketing communications will not prevent necessary transactional or account-related messages.

You are responsible for maintaining an accurate email address and reviewing communications sent to that address.

7. Changes to These Policies

EMedLearn may update these Policies as its Services, technology, and legal obligations change.

Updated Policies will display a revised effective date. When a change materially affects existing purchasers, EMedLearn will provide reasonable notice through email, the website, or the course platform.

Changes will apply prospectively except when an immediate change is reasonably necessary for legal, security, privacy, or safety reasons.

8. Governing Law and General Terms

These Policies and disputes arising out of or relating to the Services will be governed by the laws of the State of Connecticut, without regard to conflict-of-law principles.

Except where prohibited by applicable law, the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Connecticut.

Nothing in this provision eliminates a non-waivable consumer right, jurisdiction, or remedy available under applicable law.

These Policies and any additional terms expressly presented with an offer constitute the agreement between you and EMedLearn concerning the Services.

If a provision is found unenforceable, it will be modified only to the minimum extent necessary, and the remaining provisions will continue in effect.

EMedLearn’s failure to enforce a provision on one occasion does not waive its right to enforce it later.
